Puerto Rico Charters – Yacht Charter Agreement

Please read the following Terms and Conditions carefully before booking with Puerto Rico Charters. By confirming your reservation, you agree to the terms outlined below.
1. Booking & Payment
A deposit or full payment is required to secure your reservation, depending on the specific charter package selected.
Final payment must be made prior to departure of your scheduled charter unless otherwise agreed in writing.
Payments can be made by credit card, debit card, wire transfer, or any other method approved by Puerto Rico Charters.
2. Cancellation Policy
More than 5 Days Before Charter: Fully refundable.
Within 5 Days of Charter: Subject to a 25% non-refundable fee, up to a maximum of $1,000, whichever is less.
Severe Weather on Charter Day: Fully refundable or reschedule at the guest’s discretion (based on availability).
Puerto Rico Charters reserves the right to cancel any charter due to safety concerns, mechanical failure, or severe weather. In such cases, guests may reschedule or receive a full refund.
3. Weather Conditions
We closely monitor weather forecasts leading up to your charter. In cases of rain, lightning, high winds, or tropical activity, we may cancel or postpone the trip in the interest of safety.
Overcast or lightly rainy conditions that do not pose a threat to safety do not qualify for automatic cancellation or refund.
4. Guest Responsibilities
Guests are expected to treat the yacht, crew, and equipment with respect.
Any damage caused by guests or their party will be the financial responsibility of the guest who booked the charter.
Illegal drugs, weapons, or any illegal activity are strictly prohibited on board.
Excessive intoxication, disorderly conduct, or behavior endangering others may result in early termination of the charter with no refund.
5. Liability Waiver
Guests acknowledge that boating involves inherent risks, and agree to hold Puerto Rico Charters, its owners, staff, and crew harmless from any liability for personal injury, loss, or damage incurred during the charter, except in cases of gross negligence or willful misconduct.
6. Safety & Life Jackets
All charters include a safety briefing before departure.
Life jackets are provided and must be worn upon captain’s request or as required by law.
Children under a certain age (varies by jurisdiction) may be required to wear life jackets at all times.
7. Alcohol & Food
Alcohol may be consumed responsibly by guests of legal drinking age.
Guests are welcome to bring their own food and drinks, unless catering is included in your charter package.
Glass containers are discouraged for safety reasons.
8. Capacity Limits
Each vessel has a maximum passenger limit which must be strictly adhered to per U.S. Coast Guard regulations. Overloading may result in cancellation without refund.
9. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Puerto Rico. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Puerto Rico.
